Guarantee & Contractual Agreement

After talking with you about your mold problem or viewing your property in person, Moldman will provide you a Quote or Estimate

for the work to be done.  If you approve of the quote, and decide to schedule the work to be done at your property, you enter into

a verbal contractual agreement with Moldman, that includes a satisfaction guarantee.  This contract & guarantee appears below:

By approving this document, Client and Moldman, a division of Smart Assets Group LLC, (“Moldman”) hereby enter into a contractual agreement in which Moldman will perform the services outlined in the Estimate or Quote provided.  In the case of a mold inspection, Moldman pledges to take accurate samples, forward them to an experienced and knowledgeable laboratory, help the client interpret the results, and make educated recommendations to the best of their ability and knowledge.  In the case of a mold remediation, Moldman pledges to remove and treat the problem according to industry standards.  Moldman pledges to return the treated area to normal levels of mold spore count, approximate to the outside “fresh” air.  The client must understand that it is impossible to completely remove all microscopic mold spores in the area.  Mold is a part of our natural environment, and low levels of mold are always present in all air we breathe.

 

Moldman guarantees its work.  Our guarantee is that if you the client are not completely satisfied with our work, we will fix it until you are.  This is not a money-back guarantee.  Rather, it is a client satisfaction guarantee.  This guarantee lasts for six (6) months after the date the job was started.  By approving this document, client understands that even if the mold problem diagnosed by Moldman is remediated, it is possible that the mold problem could come back within a matter of days if the client does not take active steps to keep the area dry and well ventilated.  Moldman will advise the client as to the proper steps to keep the area to a normal level of mold spore count, but client understands that it is solely the client’s responsibility to perform these actions.

 

Moldman is responsible only for the services outlined in the Estimate or Quote provided.  Moldman is not responsible or liable for the non-discovery of any water damage, water problems or mold contamination or mold problems or other conditions of the subject property or any other problems which may occur or may become evident after the inspection/remediation time and date.  Moldman is neither an insurer nor guarantor against water problems, mold problems or other problems in the subject property and improvements, systems or components.  Moldman assumes no responsibility for the cost of repairing any water problems, or any other conflicts or conditions.  Moldman is not responsible or liable for any future water problems or mold problems or any future failures or repairs.

 

Moldman is not a doctor.  By approving this document, client understands/agrees that people react differently to mold.  Some may have severe allergies, while others may show no symptoms at all.  Client also understands/agrees that the effects of mold are highly debatable, largely unproven, often misunderstood, and often overblown by the media.  It is Moldman’s opinion that, clearly, if mold exists in a home, it should be treated.  Moldman pledges to remediate the mold problem, but makes no guarantees and is not to be held accountable for the health effects of the client.  Client understands that they should consult a doctor for all health/medical reasons

 

Moldman is a small company with limited resources.  Therefore, Moldman, its owners, its managers, its employees, and its advisors are limited in liability to the fee paid for the inspection/remediation services, should any claim be made by the client or any third party.  Client hereby agrees to indemnify, defend and hold harmless Moldman if any third party brings a claim against the inspection/remediation.  Client, client’s spouse, anyone related to client, and anyone living at subject property, hereby waive their right to sue or seek damages, other than the fee paid for the inspection/remediation, should a dispute or claim arise.

All claims and disputes not resolved under the terms of this Agreement shall be resolved by Arbitration that shall be provided by a (local) Member in good standing of the American Arbitration Association, or by such other means as may be mutually agreed.  The cost of such services shall be borne equally by the parties.

 

Should the client fail to pay within thirty (30) days the agreed upon sum for our services, Moldman reserves the right to place a lien on the client’s property for the amount of money owed.

 

The inspection and remediation do not constitute a warranty or insurance policy of any kind.  There are no warranties or insurance available or provided by Moldman.
